Project Description

The objectives of the project are to:

  • Provide policy advice on establishing an independent public procurement review body, including a recommended institutional set-up and appointment procedures for board members as well as a review procedure for an administrative tribunal compliant with international standards for public procurement remedies;
  • Develop the capacity of newly-appointed board members by providing high-quality, practical, and targeted training to allow the Board to commence its operations; and
  • Ensure that board members can build capacity and raise awareness among local stakeholders regarding the review and remedies procedures, including the preparation of a dedicated training program on the new public procurement review and remedies procedures.

We will produce a chapter on Georgia to be included in the EBRD handbook “Judicial Skills and Competencies for Members of Procurement Review Tribunals,” covering the following topics:

  • Overview of the public procurement system in Georgia;
  • Overview of the dispute resolution mechanism procedure;
  • Overview of the online complaints review and how it works;
  • Assessment as to whether the dispute resolution mechanism in Georgia is an independent body, as defined under the EU directive; and
  • Three case studies based on Georgian case law showcasing the implementation of the European Court of Justice’s (ECJ) principles in the local Georgian context.
